TERMS AND CONDITIONS
THE GREEN ROOF COMPANY TERMS AND CONDITIONS
1.1 These Terms and Conditions shall apply to the purchase of the goods detailed overleaf (“Goods”) by you (“Buyer”) from The Green Roof Company (NW) Ltd a company registered in UK under number 12572331 whose registered office is ℅ Burton Varley Ltd, Suite 3/2nd Floor Didsbury House, Manchester, M20 2DW (“Seller”) and to the payment of this invoice. No other terms and conditions shall apply to the sale of the Goods or to this invoice unless agreed upon in writing between the Buyer and Seller. The “seller” shall be referred to as “The Green Roof Company” and / or “TGRC”.
1.2 The essence of these Terms and Conditions remains the same as those included with the Seller’s quotation.
1.3 TGRC do not take responsibility for the correct measurement of your roofing area, this is the responsibility of you the Buyer. TGRC are not responsible for the amount of product placed in your order, you are responsible for checking the correct amounts have been added and confirmed via your invoice.
1.4 TGRC are not responsible for the decision regarding the weight bearing capacity of the roof; this responsibility lies entirely with the customer and ultimately, the products or systems they choose to purchase are within the weight bearing load of the roof.
2.1. Full payment for goods is required at least 2 working days prior to dispatch.
2.2. Payment can be made via the online invoicing system or debit and credit cards accepted (American Express not accepted) via the telephone and Online via the Secure online payment system PayPal. Bank Transfers are also accepted; the bank details are on your invoice.
2.3. If you cancel your order after the non-perishable goods have been shipped, we reserve the right to refund less any carriage costs incurred.
3.1 Our delivery turnaround times are usually within 5/6 working days upon receipt of payment and subject to availability. Quicker delivery times are possible but must be agreed by the Seller in writing.
3.2 A third party transport company is used for all deliveries and the prices are fixed for 30 days from the date of confirmation of order or quotation.
3.3 Deliveries are made on the basis the customer can accept the pallet(s) and Goods which will be delivered to kerbside only and does not include the unloading of the pallet(s). If you do have restricted access or require mechanical offload, please contact us prior to placing your order. We will always try to accommodate your needs. If a delivery fails due to access issues, we reserve the right to make a re-delivery charge.
3.4 All delivery charges are calculated when checking out. The delivery charges are for the Mainland UK only and do not apply to the Scottish Highlands, or Isles off the Mainland. Additional charges may apply for deliveries that are not classed as within the Mainland. Please call or email us to discuss this if required.
3.5 If the unloading or standing time exceeds one hour, the unloaded vehicle may leave and all costs charged to the Buyer. TGRC will not be liable for these costs.
3.6 Unloaded or standing time more than one hour will be charged at £45 per hour per vehicle. Please be aware that if the unloaded or standing time exceeds one hour, the unloaded vehicle may leave. In this event, all costs will be charged to the client. TGRC will not be liable for these costs.
3.7 Delivery damage or problems must be reported to TGRC office immediately by telephone and photographs must be taken as evidence and emailed to firstname.lastname@example.org
3.8 If there are any problems or damage to nonperishable Goods this must be reported to the Seller immediately and within 24 hours by telephone along with photographic evidence which can be emailed to:email@example.com
4.1 There is no guarantee provided on the sedum vegetation blankets as they are a living product, however, if you have any concerns upon receipt, you must contact us on 0161 445 0001 or email us firstname.lastname@example.org and provide photographic evidence.
4.2 Claims regarding non-delivery will not be accepted unless received within 24 hours from dispatch date and confirmed in writing via email.
4.3 Sedum vegetation mats must be unrolled on the day of delivery. Click ’n’ Go modular trays must be unstacked on the day of delivery.
5.0 Description of Goods
5.1 We may make changes in the specification of the goods which do not affect their quality or performance where such changes are required to conform with any applicable legal requirements.
5.2 Photographs provided on the website are for illustrative purposes only and may not exactly match the goods themselves.
5.3 The goods are only suitable for use within the United Kingdom. If you intend to use the goods outside of the United Kingdom, please contact us to discuss your specific requirements so we can advise whether goods are suitable for your intended use.
- Cancellation by Us
6.1 We reserve the right to cancel the contract between us if:
6.2 We have insufficient stock of the item(s) ordered.
6.3 We do not deliver to your area; or
6.4 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
6.5 If we do cancel your contract, we will notify you by e-mail and will re-credit your account any sum deducted by us via your original payment method as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
7.1 The Seller (TGRC) does not guarantee the performance of plants and other components supplied if installed by others.
7.2 The Seller (TGRC) is not responsible and does not accept liability for damage done to property and structures due to loading weight of the products and systems supplied. It is essential and the responsibly of you, the Buyer, to ensure that the structure is of the correct weight bearing capacity.
8.1 Sedum roofs require a minimum of twice-yearly maintenance and it is the Buyer’s responsibility to ensure the correct maintenance is carried out. Please visit our guide at: thegreenroofcompany.co.uk/maintenance You may contact us on 0161 445 0001 for advice.
- Refunds and Returns Policy
9.1 TGRC aims to provide the best quality products at all times, however, there may be occasions when goods may need to be returned and which are subject to the following Terms and Conditions.
9.2 There is no guarantee provided for the sedum vegetation blankets as they are a living product, however, if you have any concerns upon receipt, you must contact us immediately by phone on 0161 445 0001 or by email email@example.com and provide photographic evidence along with an explanation of your complaint.
9.3 If any non-perishable Goods are faulty or damaged upon receipt, you should sign the delivery note to confirm this, and you should notify TGRC within 24 hours by email firstname.lastname@example.org and provide photographic evidence along with an explanation of your complaint.
9.4. Photographic evidence of faulty or damaged Goods should be supplied and TGRC will arrange collection and are responsible for replacing these goods including shipping costs.
9.5. If any non-perishable Goods are faulty upon delivery and you do not require a placement, TGRC will refund all costs upon receipt of the Goods.
9.6. Refunds will be made within 14 days of receipt of the returned Goods and will be made via the payment method chosen when purchasing the Goods.
9.7. A ‘cooling off’ period of 7 days is your statutory right for non-perishable Goods. This begins when your order is completed and ends 7 days after the Goods have been delivered. Please inform The Green Roof Company (NW) Ltd via email email@example.com if you wish to return the goods and ensure that they are returned within 7 days of receipt. If you have changed your mind, then the packaging must be intact for the Goods to be resold as “new”. The Buyer is responsible for paying all shipping costs.
9.7. TGRC reserves the right to exercise discretion (within the confines of the law) with respect to any returns under these Terms & Conditions, to include but not limited to:
9.7.1 Any discounts or ‘Package” or “System” price that may have formed part of the purchase price of the Goods.
9.7.2. Any use or enjoyment that may have already been had from the Goods.
9.7.3. Anything that may cause the Goods to deteriorate quickly.
10.1 We reserve the right to be treated with respect and dignity, this is a two-way policy. Abusive language, threatening behaviour will not be tolerated and may result in your order being declined. Our refund policy (9) means any refunds may take up to 14 days.
